Delay

We need him back!

Tom DeLay. Wasn't that his name?

The leader of the GOoPers?

His name would be apt which is about the only thing there could be.

Tom DeLay who got his dick caught in the wringer or something like that. No. It was money laundering.

Anyway, I digress.

Republicans See How Long They Can Hold Their Breath

Gail Collins reviews the bidding on the hold out to fill the Supreme Court vacancy left by Scalia.

I think Obama is up to the task. Which is to name someone that it will be hard to say no to. The GOoPers are a circular firing squad when that happens. So, divide and conquer.

Or he could name someone who is so partisan that right wing will go nuts and make a fool of themselves which they do regularly anyway but when they get real whacked out they are a hilarious spectacle.

It must be fun to sit in the White House right now and watch the hypocrisy, the outright lying and the serious discomfort that the Senators are in.

They started opposing him before Scalia's body was cool.

Have a heart guys.

But there is no heart there and what is left is not a candy heart either. More like a shriveled up remnant of the time that they were happy and carefree youngsters. Who went wrong.

So they are stuck. A part of the demand that Obama not nominate anyone until the general election is over is a pure desire not to have to commit political suicide. Again.

Mitch McConnell, the guy who looks like a turtle, should just pull his ugly head into his shell and let events unroll.

After all, that is what their beloved Constitution tells them they should fucking do.

Their turn will come and then they can say no, yes or try to delay it then. Which would also make them look like the fools they are.

And then there is this.

Obama Compiles Shortlist Of Gay, Transsexual Abortion Doctors To Replace Scalia

From the Onion.

Death row

As in "a row", a fight or argument.

Does a Supreme Court Justice just say, "oops"?

This puts the savage practice of capital punishment in the limelight. A guy in North Carolina has been exonerated as a result of new evidence. The Supremes had turned his appeal down. I wish they would turn the death penalty out of existence. But they hang onto it, particularly the noisome Scalia (what an apt name, drips of evil, the kind of name that an author would love to use to denote villainy).

Scalia is an unrepentant deathist. He is at the forefront of the killers on the Court. We know he is also an arrogant asshole and the most detestable appointment to the Supremes in my lifetime.

It is the arrogance that grinds my ass more than anything.

I am just ranting here.

I have nothing to say about this bastard. Nothing good. And words cannot describe the wrongness of his sitting on this Bench.

A creep.

ROBERTS

I spent most of the morning reading about the Supremes' decision on the Affordable Care Act.

A lot of reflection on Roberts. His decision not to join the conservative thugs.

What is up with that?

I think several things.

One, he is not a thug. He has to be tired of being tarred with the same brush as his brethren. He is not a thug.

He has recently opined about polarizing. The left, the right.

He is an honest, perhaps old style Republican. That means he is open, perhaps the only Republican power, to compromise.

History tells us that many Justices tone it down once they are on the Court for awhile. Some even jump the fence or wander across the fuzzy lines that divide us.

It takes a while, I think, to realize that one is now a Supreme and not really accountable to anyone except the law and the Constitution. He can retire from the politics of it.

I see more of a human being in his persona.

As always, I am optimistic.

This is a turning point for the Court. There are at least two likely appointments by the next term President. Perhaps Roberts is looking forward to that. Maybe he thinks that it is Obama. I do too.

Count your chickens.

Line them up.

He has a legacy to think about.

I, for one, am glad to recognize him as one of the thinkers and the wise.

I am not alone in this.

Re-examination of Roberts' Legacy?

If Mr. Bush ends up ruing the day he chose Mr. Roberts to lead the court, he would not be the first former president to do so. Mr. Bush’s father appointed Justice David H. Souter, who ended up as a mainstay of the court’s liberal wing. President Dwight D. Eisenhower was said to have called his appointments of Chief Justice Earl Warren and Justice William J. Brennan Jr. as two of his biggest mistakes.

LET THEM SHOW THEIR COLORS

I am with Kevin Drum,

The Partisan Supreme Court

There have been a lot of flaps about "partisan" appearances by members of the mostly conservative Supremes.

To act as though the Court is not partisan is a major case of denial.

The Warren Court was partisan.

So is this one.

Let them show up wherever they want and keep it open. Better to have the lights on and everyone walking around than to be in the dark.

Let's even take pictures.

And I am serious about it. Show the liberals too.

KAGAN-10, THOMAS-0

Today was Kagan's first day as a Supreme.

She was a busy bee.

On First Day, Kagan Fills Chamber With Queries, Comments

Good.

I have just read a rather lengthy New Yorker article about Breyer as a key vote on the court from here on out.

In that article, I learned again that a Justice is not just a voter. He is an influencer. She can make an enormous difference by what answers she solicits in open court and, particularly, the way that s/he writes dissents. Breyer is an artist with the dissent.

An active liberal is much more influential even on a biased, political court if she is mouthy and forthcoming and preempts certain avenues of decision.

Sotomayer is also a busy bee in the open hearings. These two women are going to vex Roberts and his gang.

Clarence Fucking Thomas. A disgrace.
